Permits Required - O‘ahu

Some practices selected for your Conservation Plan may require permits from other government agencies. Cooperators are required to obtain the necessary permits prior to installing practices. Please contact the these agencies for information on permits required for your project.

Permits other than those listed here may be required for your project. You are responsible for obtaining all permits before starting work.

City & County of Honolulu -
Department of Planning & Permitting

The Planning & Permitting Department is responsible for issuing Grading, Grubbing and Stockpiling Permits for soil-disturbing work exceeding specific amounts. Special Management Area permits are also issued for projects near coastal areas and is tied to Coastal Zone Management Program requirements.

Permit fees start at $45 for stockpiling over 100 cubic yards, and $90 for grubbing over 15,000 square feet. Grading permit fees start at $45 (50 to 1000 cubic yards), $450 (1001 to 10,000 cubic yards), and $855 (over 10,000 cubic yards).

If you have received a citation for grading, grubbing, or stockpiling, you have 30 days to acquire a permit or correct the problem before a fine is issued. Another 30 day extension may be possible (at the Inspector’s discretion) if you can show you are actively working to correct the problem. Hawai‘i Department of Health - Clean Water Branch

The Clean Water Branch is responsible for issuing the Clean Water Action Section 401 Water Quality Certification, which is needed when a Section 404 permit is required. The Clean Water Branch also issues the National Pollutant Discharge Elimination System (NPDES) permit for point discharges into streams, the ocean, and other waters. Other branches withinDOH issue wastewater, solid waste, hazardous waste, burning, and other related permits.

The Corps of Engineers is responsible for issuing Clean Water Act Section 404 permits for discharges of fill into streams, wetlands and other waters of the US.

Hawai‘i Department of Land and Natural Resources - Commission on Water Resources Management

The DLNR Commission on Water Resources Management is responsible for issuing the Stream Alteration and Stream Diversion Permits. These permits may be required even if a Corps Of Engineers' permit is not required.
