Permits Required - Maui County

Some practices selected for your Conservation Plan may require permits from other government agencies. Cooperators are required to obtain the necessary permits prior to installing practices. Please contact the these agencies for information on permits required for your project.

Permits other than those listed here may be required for your project. You are responsible for obtaining all permits before starting work.

Maui County - Department of Public Works

Maui County Department of Public Works grants exemptions to the Grading, Grubbing and Stockpiling ordinances to producers on agricultural land that have obtained a completed conservation plan through a Maui SWCD.

For those without a completed plan, permit requirements and fees are applied to projects with stockpiling over 500 cubic yards and grubbing over an acre. Grading permits are required for projects that excavate over an acre, or excavate or fill more than 15 feet in height.

Hawai‘i Department of Health - Clean Water Branch

The Clean Water Branch is responsible for issuing the Clean Water Action Section 401 Water Quality Certification, which is needed when a Section 404 permit is required. The Clean Water Branch also issues the National Pollutant Discharge Elimination System (NPDES) permit for point discharges into streams, the ocean, and other waters. Other branches withinDOH issue wastewater, solid waste, hazardous waste, burning, and other related permits.

US Army Corps of Engineers

The Corps of Engineers is responsible for issuing Clean Water Act Section 404 permits for discharges of fill into streams, wetlands and other waters of the US.

Hawai‘i Department of Land and Natural Resources - Commission on Water Resources Management

The DLNR Commission on Water Resources Management is responsible for issuing the Stream Alteration and Stream Diversion Permits. These permits may be required even if a Corps Of Engineers' permit is not required.
