
Permits Required - Kaua‘i
Some practices selected for your Conservation Plan may require permits from other government agencies. Cooperators are required to obtain the necessary permits prior to installing practices. Please contact the these agencies for information on permits required for your project.
Permits other than those listed here may be required for your project. You are responsible for obtaining all permits before starting work.
Kaua‘i County - Department of Public Works

Cooperators that obtain approved and completed conservation plans through the Kaua‘i SWCDs may qualify for exemptions to the Kaua‘i County Grading, Grubbing and Stockpiling ordinances. The Districts have complied a Agricultural Exemptions to the Kaua‘i County Sediment & Erosion Control brochure
to address frequently asked questions.
For those without a completed plan, permit requirements and fees are applied to projects with stockpiling over 500 cubic yards and grubbing over 1 acre. Grading permits are required for projects that excavate over 100 cubic yards, excavate or fill more than 5 feet, or alter any drainage patterns. Hawai‘i Department of Health - Clean Water Branch

The Clean Water Branch is responsible for issuing the Clean Water Action Section 401 Water Quality Certification, which is needed when a Section 404 permit is required. The Clean Water Branch also issues the National Pollutant Discharge Elimination System (NPDES) permit for point discharges into streams, the ocean, and other waters. Other branches withinDOH issue wastewater, solid waste, hazardous waste, burning, and other related permits.

The Corps of Engineers is responsible for issuing Clean Water Act Section 404 permits for discharges of fill into streams, wetlands and other waters of the US.
Hawai‘i Department of Land and Natural Resources - Commission on Water Resources Management

The DLNR Commission on Water Resources Management is responsible for issuing the Stream Alteration and Stream Diversion Permits. These permits may be required even if a Corps Of Engineers' permit is not required.
